This agreement

  • Explains our obligations to you and your obligations to us; and
  • Applies to all business accounts you have with us and the services we provide in connection with those accounts; and
  • Includes the terms applicable to the use of our website: www.check-first.co.uk

Definitions:

“Application Information” means information provided by potential job applicants, current employees or tenant applicants that you or they give to us by completing the online questionnaires so that we may conduct the Checks requested.

“Background Screening Service” means the service offered to confirm the background of potential job applicants, current employees and tenant applicants.

“Checks” means all those actions we take to confirm the application information provided by your candidates and includes: requests for references from previous employers, landlords and professional people known to the candidate; confirmation of membership of professional bodies and directorships held; confirmation of qualifications obtained and of jobs held; personal identification and confirmation of address history over the last five years; Criminal Records Checks.

“Candidate Report” means the confidential report that results from the conduct of the Checks requested by the employer or landlord in connection with a specific job or tenancy and authorised by the candidate by virtue of the completion of the relevant questionnaires by him/her.

“Charges” means the fees you pay for our services, based on the purchase of credits.

“Cookies” are files stored on the User’s PC or mobile device by the Web Browser as requested by the Web Server. This file is transmitted to the Web Server each time the Web Browser requests information from the Web Server and is used as a means of customising web pages and facilitating use of the website.

“Credits” means a unit of purchase used by us to enable Checks to be ordered.

“Criminal Records Checks” means those Checks completed by the Disclosure & Barring Service (England), Access NI (Northern Ireland) and Disclosure Scotland (Scotland) in connection with employment or occupations that fall within the Exceptions Order 1975 of the Rehabilitation of Offenders Act 1974.

“CV Verification” means all those actions we take to confirm the applicant information listed under Checks together with the Candidate Report that results therefrom.

“Principal Account Holder” means the person nominated by the employer to exercise financial control of the employer’s dealings with us.

“Register” means the process whereby you first enter your company details to enable you to use the login and security items provided by Check First to access and use this site.

“We”, “Us” and “Our” means Check First Limited (Registered Number 6508694), its employees and authorised representatives. Our registered office is c/o McManus Hall, Unit C11 Marquis Court, Team Valley Trading Estate, GATESHEAD, NE11 0RU.

“Web Browser” runs on the User’s PC or mobile device and requests information from any Web Server on the World Wide Web (www).

“Web Server” based on requests from the Web Browser, the Web Server returns pages of information to be viewed by the user on his/her own PC.

“Website” means the website at www.check-first.co.uk or any other website through which we deliver the services.

“You” and “your” means an individual Candidate posting his/her details on our Website; and/or the client Company named in the Registration Form on the Website and includes where appropriate any person authorised to give instructions to us.

General

The use of our Website and any contracts formed are governed by English law.

Any person who is not party to these terms and conditions shall have no right to enforce any term under the Contracts (Rights of Third Parties) Act 1999.

If any provision of these terms and conditions is found to be invalid or unenforceable by a court the invalidity or unenforceability of such provision shall not affect the other provisions of these terms and conditions.

We may assign or transfer any of our rights or sub contract any of our obligations under these terms and conditions to any third party.

You may not assign or transfer any of your rights or sub contract any of your obligations under these terms and conditions except with our specific permission in writing.

We reserve the right to change these terms and conditions from time to time and any such changes will be communicated by email to relevant account holders and be amended within our terms, published on our Website.

There are from time to time links on our Website to third party websites which we believe may be relevant to our business and of interest to our clients. We do not have any control over the content of these Websites nor can we be liable in respect of anything contained on these Websites.

These terms and conditions govern the entire trading relationship between you and us and will remain in force for the duration of our trading relationship.

All intellectual property rights (including use of trade marks) shall be solely owned by us. You are permitted only to use material on this website as expressly authorised by us.

Any unauthorised use of material on this site is strictly prohibited.

Delivery policy

Check First Limited will use its full resources to complete its searches and compile a detailed Candidate / Tenant Report within required Timescales.  These details are outlined within our Service Level Agreement which is provided when an Account is opened.

Check First is reliant on the information provided by the Candidate / Applicant being accurate and current when processing Checks.  There may be occasions where additional information or authorisation from the particular Candidate / Applicant is required.

Our focus is to provide the required report for every request. Check First will use its best endeavours and all reasonable channels in its attempts to secure a response to a reference request or confirmation of qualifications, or any other validation.

Check First cannot be held responsible for delays caused by third parties and the time taken to respond to requests for information; or for other events outside of our control.

Where a reference request has been met with a refusal to reply, Check First will record a Nil Return within its report to the instigator of the request.

When reports are complete an email will be sent to the registered user confirming that the report has been completed and inviting them to log into the system to view and download it.

Limit of Liability

Check First Limited will use its best endeavours to ensure the accuracy of the information contained within a Candidate’s Report. However, we cannot be held responsible for the content of a Report where that content has been supplied by third parties who have been approached by us in connection with the Checks carried out upon any Candidate; or for the use made of such information by potential employers concerning the offer of employment or the withdrawal of an offer of employment.

When an account is created you are confirming your acceptance of our Terms and Conditions and agree that you have entered into a binding contract whereby you:

  • instruct us to carry out the Checks detailed thereon;
  • agree that we may deduct the relevant number of Credits from your Account.

We shall not be responsible for inaccurate information provided by individuals for the purposes of obtaining references.

We shall not be responsible to you whether in contract, tort (including negligence) or otherwise for incidental, special, indirect or consequential loss or damage, any loss of profit (direct or indirect), loss of sales, loss of goodwill or reputation, loss of business, third party claims, pure economic loss arising out of or in connection with the performance or non-performance of our obligations under our customer agreement including such damage as may be reasonably foreseeable at the date you order the Checks.

Nothing in these terms and conditions shall exclude or restrict our liability for death or personal injury caused by our negligence.

Our liability for any claim for loss or damage shall be limited to the sum paid by you for the Checks.

Pricing Structure and Payment Process for employers

Our pricing structure is based on a credits based system for both Employer and Landlord Accounts which are easy to utilise.  Bundles of Credits can be purchased in advance or when required.  As of 01st January 2016 each Credit is worth the value of £3.50.

Authorising Checks for an Employment Account

Once one or more Candidates have completed and submitted their questionnaires all parties will receive an email confirming the submitted application.

To proceed with any Checks there must be sufficient Credits on your account.  To order more Credits click on the Request Credits button from the left hand navigation menu.

With an Employee Account Checks can only be initiated on Candidates that are shortlisted.  To shortlist, click on the required Job, Candidates, Add to Shortlist.

Shortlisted Candidates are found by clicking on the required Job, Shortlist.  To initiate Checks, click on the relevant Candidate Name and Order Checks.

Authorising Checks for a Landlord Account

Once a Tenant has completed and submitted their questionnaire all parties will receive an email confirming the submitted application.

To proceed with any Checks there must be sufficient Credits on your account.  To order more Credits click on the Request Credits button from the left hand navigation menu.

To initiate Checks click on the required Property, Applicant and Order Checks.

Payment Process for Requesting Credits

Credits can be purchased at any time within a registered Employment or Landlord Account by the Principal Account Holder using a Company Business, Corporate or Purchasing Credit or Debit Card.

The Principal Account Holder chooses the required number of credits (minimum bundle is 10 Credits) and clicks on the “Make Payment” button.  This transfers to a secure payment site, which meets all security and transaction processing software standards, including full compliance with the Payment Card Industry Data Security Standard (PCI DSS).

To proceed and authorise payment, the individual updates the card details and completes required security protocol. Check First does not see or record any Credit Card details during this process. We accept the following cards: Visa, MasterCard and American Express.

When payment has been processed, the individual will be returned to their Check First Account and a VAT receipt will be emailed to the Principal Account Holder.  Credits are instantly updated to the account ready to proceed with the Check order.

Refund Policy

Credits purchased are non-refundable and do not expire.  Credits purchased on one account cannot be transferred between accounts.

Check First will use its endeavours and all reasonable channels in its attempts to secure a response to a reference request or confirmations or qualifications, or any other validation.

Where it has met with a refusal to reply, Check First will record a Nil Return within its report to the instigator of the request.

As of 01st January 2016 each Credit is worth the value of £3.50.

It is the responsibility of the authorised user to check the details of the of the Candidate or Tenant that they are correct before submitting a request for Checks to be processed.
